What is an Easement?

An easement is an area of land that is set aside by law for a specific purpose, usually documented on a land title/lot plan. Council and other service authorities manage a significant portion of its asset network through easements.

When is Council consent required to undertake works within an Easement?

Residents must get consent from Greater Dandenong City Council if you are doing any work:

  • On or over an Easement, or
  • Within 1 metre of a Council asset.

Residents must get consent from any other authority that has use of the easement, for example, water/sewer/power.

When is Council consent not required to undertake works within an Easement?

Residents don't need Council consent for:

  • Turf, mulch, gravel, stepping-stones or removeable ground cover and surface level treatments.
  • Temporary or portable items, for example, furniture, garden ornaments, trampolines or similar that are not affixed to the ground.
  • Side or rear boundary fences (timber or colourbond, two metres high or less).

What Type of Consent do I need?

There are two types of consent dependent on the type of works proposed.

For major works requiring a Building Permit or anything that affects building safety.

Apply for Report and Consent (Regulation 130) 

For small, simple, or temporary works/projects that do not require a Building Permit.
